Oregon Program Seen Prompting Unlawful Return Visit

  • Oregon employers should be aware that the state OSHA’s recently-effective “Programmed Inspections for Cause” enforcement program could result in an unlawful return visit, according to attorneys at Seyfarth Shaw.
  • A law firm blog post this week noted that one of the conditions of the program for a mandated comprehensive, or wall-to-wall, inspection is “most legally dubious.”
  • “The program permits Oregon OSHA’s Administrator to target employers for inspection so long as they are on a ‘bad history’ list.” wrote authors Patrick Joyce, Adam Young and Jacob Roes.

Risks in Cut-Off Saw Use Prompt Guidance

  • The Center for Construction Research and Training has issued a guide and called for more training in the use of hand-held cut-off saws, after the group’s analysis of OSHA Fatality Inspection Data highlighted the severe risks of improper use of the equipment on construction sites.
  • Struck-by incidents, including those caused by saws, are the leading cause of non-fatal traumatic injuries and the second leading cause of fatalities among construction workers.
  • As well, silica dust created by cut-off saws is a potential health hazard.
  • Developed with NIOSH’s National Occupational Research Agenda Construction Sector Council’s Struck-By Work Group, the guide offers several best practices for safe use of cut-off saws.
