Michigan Employers Cautioned on Acting Against Complaining Worker
- Michigan employees now have a potential cause of action for retaliatory discharge for exercising rights under OSHA and MiOSHA, in the wake of a July state Supreme Court ruling, according to attorneys at Dickinson Wright.
- Writing about the case Stegall v. Resource Tech Corp., No. 165450; 2024 WL 3503503 (Mich. Sup. Ct. Jul. 22, 2024), lawyers Aaron Burrell and Timothy Howlett said Michigan employers should be careful when considering adverse employment action against an individual who has made recent complaints regarding workplace safety issues.
- They wrote that “Taking an adverse employment action after an employee makes a complaint may expose the employer to retaliation claims, irrespective of whether there is support.”

- Law enforcement officials in Canada’s Alberta province are offering a $10,000 reward in the shooting death earlier this month of a Rocky View County employee.
- The RCMP said a reward offer isn’t common.
- A total of 165 workers died in the workplace in Alberta in 2023, according to data from the provincial government. That’s up from 161 in 2022.
- Last year, 89 workers died of occupational diseases, 39 died due to trauma and 29 succumbed to motor vehicle incidents, according to the Workers’ Compensation Board of Alberta.
