OSHA changes prompt states to drop lawsuit

• Six states — Illinois, Maryland, Massachusetts, Minnesota, New Jersey, and New York — are dropping their lawsuits against OSHA after the agency finalized changes to its revised rule on submitting annual injury and illness data.
• The attorneys general of these states filed suit against the federal government in March 2019 after OSHA changed its recordkeeping regulation to require only submissions of data from Form 300A, which is a summary of work-related injuries and illnesses.
• The revised rule, published July 21 and set to go into effect Jan. 1, requires establishments with 100 or more employees in certain high-hazard industries to submit data from the more detailed Forms 300 and 301, in addition to Form 300A, by March 2 each year.
• Form 300 is a log of work-related injuries and illnesses, while Form 301 features incident reports that correspond to each entry on Form 300.

Colorado contractor faces sentencing after worker’s death

• The owner of an Avon construction company whose failure to follow required federal safety standards led to the 2021 trench collapse death of a 23-year-old employee awaits a November sentencing date after pleading guilty to manslaughter.
• The plea follows a criminal referral by the U.S. Department of Labor after Peter Dillon and his now-defunct company, A4S LLC refused to require the use of proper safety equipment to protect his workers.
• The refusal contributed to a trench collapse in which a company employee, Marlon Diaz, suffered fatal injuries as he installed a residential sewer line.
•  A4S LLC received three willful citations from OSHA in May 2022 for not ensuring the excavation was inspected by a competent person, failing to instruct employees on the recognition and avoidance of unsafe conditions and not having a trench protective system,

Another safety resource for migrant workers

• The Department of Labor launched a website available in English and Spanish that features information on immigrant worker rights and other job-related resources.
• MigrantWorker.gov – or TrabajadorMigrante.gov – has information for workplace safety and health, recruitment, wages and hours, retaliation, discrimination and harassment, trafficking, support from a worker’s home country, and how to file a claim.
• The website includes lists of FAQs and their corresponding answers. Among the questions:

Investigation after serious injury at Boston Logan Airport

• An investigation has been opened after a forklift operator was seriously injured in an accident outside Terminal C at Boston Logan Airport.
• A man suffered life-threatening injuries after part of a forklift struck a stationary structure, which caused the forklift to fall on top of the victim.
• The worker, a subcontractor for JetBlue, was doing maintenance work for the airline near Gate C26, according to MassPort.
• There were no planes in the area at the time of the incident.
